POA full form in different contexts
| Context | POA stands for | Example |
|---|---|---|
| Law and property | Power of attorney | A son signs a sale deed for his father abroad |
| Banking and KYC | Proof of address | A utility bill submitted to open an account |
| Demat and broking | Power of attorney | Authority to the broker to debit shares on sale |
This guide covers POA as power of attorney, which is what most people search for.
What a power of attorney means in India
The Powers of Attorney Act, 1882 governs these documents. A power of attorney lets the agent sign papers, appear before offices and manage property for the principal.
The agent acts only within the powers written in the document. Anything outside them does not bind the principal.
Types of POA in India
| Type | What it allows | Common use |
|---|---|---|
| General power of attorney (GPA) | Many acts on the principal behalf | Managing property and accounts during a long absence |
| Special power of attorney (SPA) | One defined act or transaction | Registering one sale deed or one lease |
| NRI power of attorney | Acts in India for a principal who lives abroad | Property, bank and tax matters |
| Irrevocable POA | Cannot be cancelled at will, usually tied to an interest | Some loan and developer arrangements |
Stamp duty, notary and registration
A POA is printed on stamp paper or e-stamped. Stamp duty depends on the state and on the type of POA. A POA that lets the agent sell immovable property often pays a higher duty.
Most POAs are signed before a notary. A POA that deals with immovable property is usually registered with the sub-registrar, and several states make that registration compulsory.
In 2011 the Supreme Court held in Suraj Lamp and Industries v. State of Haryana that a sale through a general power of attorney does not transfer title. Property is sold by a registered sale deed.
POA for NRIs
A principal who lives abroad signs the POA before the Indian embassy or consulate, or before a local notary with an apostille. Once it reaches India, it is usually adjudicated for stamp duty within the period the state law sets.
The agent then uses it to register documents, manage rent, deal with banks and appear before tax authorities.
Can a POA be signed electronically in India?
No. The Information Technology Act, 2000 leaves powers of attorney out of its scope in the First Schedule. The same schedule leaves out negotiable instruments other than cheques, trusts, wills and contracts for the sale of immovable property.
A POA in India is printed, signed in ink and taken to the notary or the sub-registrar. SignSolú is used for the letters, agreements and authority letters around it that the Act does allow.
What a POA must contain
- Names, ages, addresses and identity details of principal and agent.
- A clear list of the powers, act by act for an SPA.
- The property details, when the POA concerns property.
- Whether the agent can appoint a substitute.
- Duration or the event that ends it.
- Signatures of the principal, two witnesses and the notary or sub-registrar.
How a POA is revoked
The principal signs a deed of revocation and gives notice to the agent and to anyone who relied on the POA. If the POA was registered, the revocation is registered too.
A POA also ends at the death or insolvency of the principal, or when the specific act it allowed is complete.
Documents you can sign online

Common mistakes with a POA
- 1Vague powers. The sub-registrar or the bank refuses a POA that does not name the act.
- 2Wrong stamp value. An underpaid POA is rejected until the duty and penalty are paid.
- 3Not registering when the state requires it. The property office will not accept it.
- 4Using a GPA to sell property. Since Suraj Lamp, title passes only by a registered sale deed.
- 5Forgetting to revoke. An old POA in the wrong hands is a risk.
An example
Anil works in Dubai and owns a flat in Pune. He signs a special power of attorney at the Indian consulate, authorizing his brother to sign one sale deed for that flat.
The brother has the POA adjudicated in Pune, signs the registered sale deed before the sub-registrar and receives the payment into Anil account. The POA ends when the sale is done.
