What the law says

The California Probate Code sets the rules for powers of attorney. It includes a statutory short form and asks that a power be dated, signed by the principal and either acknowledged before a notary or signed by two qualified adult witnesses. The agent cannot be a witness.

A power used to sell or mortgage real estate is recorded with the county recorder, which needs a notarized document.

Statutory form or custom form

California publishes a uniform statutory form power of attorney. Banks recognize it easily. This template follows the same structure in plain language and adds an acceptance by the agent.

You may also add instructions that the statutory form does not cover, such as a limit on selling your home.

Notary or witnesses

OptionWho signsBest for
Notary acknowledgmentPrincipal before a notaryReal estate and banks
Two witnessesTwo adults who watch the principal signOther financial matters

Special rules apply if the principal lives in a skilled nursing facility. Ask the facility about its patient advocate before signing.

A worked example

Grace, 81, names her son Kevin as agent with her daughter as successor. She chooses durable and immediate.

She signs at her bank in San Jose, where a notary acknowledges her signature. Kevin later uses the notarized copy to refinance her home.

Mistakes to avoid

  • The agent signs as a witness. California does not allow it.
  • No notary for real estate. The county recorder will not accept it.
  • Forgetting the date. An undated power can be rejected.

Health care in California

This form covers money and property. California uses an advance health care directive to name a health care agent and record your wishes. See the medical power of attorney form for what such a document covers.

Checklist before you sign

  1. 1The date is filled in.
  2. 2Each power you grant is initialed.
  3. 3You chose durable or not durable.
  4. 4You will sign before a notary, or before two adult witnesses who are not the agent.
  5. 5Real estate powers come with a notary acknowledgment.

Then give the agent a copy and keep the original in a safe place.

Revoking a California power

Sign a written revocation, date it and give it to your agent. Send copies to every bank or office that relied on the power. If the power was recorded with the county, record the revocation there too.

A new power of attorney does not always cancel the old one automatically. Say so in the new form, or sign a separate revocation.

Keep a copy of the revocation with your records, along with proof that you sent it.

Your agent should keep that proof too, in case a bank asks.
