What the law says

The Electronic Commerce Act (Republic Act 8792) gives electronic documents and electronic signatures legal recognition in the Philippines. A deed of sale signed electronically binds the buyer and the seller.

A deed of sale used to transfer registration with the Land Transportation Office (LTO) must be notarized. Under the notarial rules, the seller and the buyer appear before a notary public with valid IDs. Print the filled-in deed and sign it there for the LTO copy. The LTO counts its transfer deadline from the date the deed is signed and charges a fee for late transfers, so file soon after the sale.

Sales of personal property follow the Civil Code. Ownership passes on delivery of the vehicle, and the deed records the price, the date and the condition.

What the LTO usually asks for

  • The notarized deed of absolute sale.
  • The original Certificate of Registration (CR) and latest Official Receipt (OR).
  • Valid IDs of the seller and the buyer.
  • A motor vehicle clearance from the PNP Highway Patrol Group.
  • Proof of insurance and any inspection the LTO office requires.

Requirements can change by LTO office. Call or check with the district office before you go.

Why the delivery time matters

Clause 5 sets the date and time the buyer took the car. From that moment, accidents and violations are the buyer’s. Until the LTO records the transfer, the seller’s name is still on the registration.

That is why sellers should push for a quick transfer and keep a copy of the signed deed. The online signature also records the exact time each party signed.

Step by step

  1. 1Check the CR, OR and the engine and chassis numbers on the car.
  2. 2Agree the price and how it will be paid.
  3. 3Fill in the deed and sign it online with the buyer.
  4. 4Print it and sign before a notary with two witnesses.
  5. 5Hand over the car, keys, CR and OR.
  6. 6The buyer files the transfer with the LTO.

A worked example

Roberto sells his 2019 Vios to Angela for ₱500,000. They sign the deed online in the morning and meet a notary at 2 p.m.

Angela pays by bank transfer and takes the car at 3 p.m. She brings the notarized deed, the CR and OR and her HPG clearance to the LTO that week.

Mistakes to avoid

  • Open deed of sale. A deed without the buyer’s name leaves the seller liable for years.
  • Wrong engine or chassis number. The LTO will reject the transfer.
  • No delivery time. Without it, nobody can say who had the car on a given day.

Paying safely

Bank transfers and manager’s checks leave a record. If you pay in cash, count it in front of the notary or a witness and write the amount in clause 2.

Frequently asked questions

Is a deed of sale for a car signed online valid in the Philippines?

Yes, between the parties. Republic Act 8792 recognizes electronic signatures. For LTO or Registry of Deeds filings, the deed is also notarized.

Does the LTO accept a car deed of sale signed online?

The LTO transfer asks for a notarized deed. Print the filled-in deed and sign it before a notary for the LTO. The copy signed online records the deal between buyer and seller from the start.

Does the buyer need a SignSolú account to sign?

No. They open the link on their phone and sign with the brown bar at the bottom of the screen.

Can I download the deed of sale in Word?

Yes. “Download in Word” gives you the full deed of sale with no email and no account. You can print it or edit it and sign it here later.

Who pays for the notary and the LTO transfer?

The parties agree. The buyer usually pays the LTO fees, and the notary fee is often shared.

What is an open deed of sale?

A deed signed by the seller with the buyer’s name left blank. It keeps the seller on the record and is best avoided.
