What the law says

The Electronic Commerce Act (Republic Act 8792) gives electronic documents and electronic signatures legal recognition in the Philippines. A motorcycle deed of sale signed electronically binds the buyer and the seller.

A deed of sale used to transfer registration with the Land Transportation Office (LTO) must be notarized. Under the notarial rules, the seller and the buyer appear before a notary public with valid IDs. Print the filled-in deed and sign it there for the LTO copy. The LTO counts its transfer deadline from the date the deed is signed and charges a fee for late transfers, so file soon after the sale.

Sales of personal property follow the Civil Code. Ownership passes on delivery of the vehicle, and the deed records the price, the date and the condition.

Selling a motorcycle that still has a loan

If the motorcycle was bought on installment, the financing company may hold the CR or have a mortgage annotated on it. Pay off the balance and get the release of chattel mortgage before you sign the deed.

The buyer should ask to see the original CR and OR. Copies are not enough.

What the buyer brings to the LTO

  • The notarized deed of absolute sale.
  • The original CR and the latest OR.
  • Valid IDs of seller and buyer.
  • The PNP Highway Patrol Group clearance.
  • Insurance and any inspection the LTO office requires.

Step by step

  1. 1Match the engine and chassis numbers on the motorcycle to the CR.
  2. 2Agree the price and payment.
  3. 3Sign the deed online.
  4. 4Print and sign before a notary with two witnesses.
  5. 5Hand over the motorcycle, keys, CR and OR.
  6. 6The buyer files the transfer with the LTO.

A worked example

Mark sells his Honda Click to Jessa for ₱65,000. They sign the deed online at noon and see a notary in the afternoon.

Jessa pays by GCash, then rides the motorcycle home at 5 p.m., the time written in clause 4. She files the transfer at the LTO with the notarized deed.

Mistakes to avoid

  • Selling with a chattel mortgage still on the CR. The LTO will not transfer it.
  • Only photocopies of the CR and OR. Ask for the originals.
  • Open deed of sale. Always write the buyer’s full name.

Paying safely

GCash, Maya and bank transfers leave a record. For cash, count it in front of a witness and write the amount in clause 2.

After the sale

The seller keeps a copy of the signed deed and the notarized print. If a traffic violation arrives before the LTO records the transfer, the delivery time in clause 4 shows who had the motorcycle.

Checklist before you meet the notary

  1. 1Both of you bring two valid IDs.
  2. 2The original CR and latest OR are on hand.
  3. 3The engine and chassis numbers in the deed match the motorcycle.
  4. 4Two witnesses are ready to sign.
  5. 5The price and delivery time are filled in.

Once the notary signs, take photos of every page before you hand over the originals.

Keep those photos with the signed PDF.

Can I sell a motorcycle without the original CR?

The LTO needs the original. If it is lost, request a replacement first.
