What the law says

Month-to-month tenancies are periodic tenancies under state law. The notice to end them is often 30 days, but some states require more, especially after the tenant has lived there a long time. Some cities only allow ending a tenancy for listed reasons.

Rent increases also need notice. Some states require longer notice for larger increases, and some cities cap increases. Clause 4 refers to the longer notice when the law requires it.

The EPA lead-based paint rule applies to older homes. The ESIGN Act lets both sides sign the agreement electronically.

State differences

Month-to-month rentals are where state and city rules differ most.

  • Security deposit. Many states cap the amount and set a deadline to return it with an itemized list of deductions.
  • Notice to end or change a tenancy. Thirty days is common for month-to-month rentals. Some states and cities require more.
  • Late fees. Some states cap them or set a grace period.
  • Entry by the landlord. Many states set a minimum notice, often 24 hours, except in emergencies.
  • Required disclosures. Mold, flood zones, bed bugs and who manages the property appear in some states.
  • Rent control. A few states and many cities limit rent increases for some buildings.

When a month-to-month lease makes sense

  • The landlord plans to sell or move in within months.
  • The tenant is between jobs, homes or cities.
  • A fixed-term lease ended and both sides want to keep going.
  • A trial period before a longer lease.

If either side wants certainty for a year, a fixed-term lease agreement is the better choice.

How notice works

Notice must reach the other party a full rental period before the end date in most states. With rent due on the 1st, notice given on October 15 usually ends the tenancy on November 30.

Send every notice in writing. Signing it with SignSolú gives you a dated record of when it was sent and opened. A lease termination letter has the wording ready.

Raising the rent

Give written notice before the new rent starts, at least as long as clause 4 and the law require. State the new amount and the date.

Tenants may then stay at the new rent or give notice to leave. Check any local rent control before you set the amount.

A worked example

Marco rents his condo to Hannah month to month while he decides whether to sell. Rent is 1,450 USD.

In March Marco decides to sell. On March 25 he sends written notice ending the tenancy on April 30, more than 30 days later. Hannah signs to confirm receipt and moves out on time.

Mistakes to avoid

  • Notice by text without a record. Use a method that shows the date it was sent.
  • Too little notice. Count the days and check your state’s minimum.
  • Unwritten rent changes. A rent change must be in writing to hold.

Signing the notices online too

The agreement is only the start. Rent changes, notices to end and move-out dates all need a written record.

Send each one as a document to sign. The other side confirms receipt from a phone, and the certificate shows the date. That record ends most disputes about when notice was given.

Checklist before you send it

  1. 1The notice period in clause 2 meets your state and city minimum.
  2. 2The rent change notice in clause 4 does too.
  3. 3The email addresses for notices are correct.
  4. 4The deposit amount fits your state’s cap.
