The full sublease agreement

SUBLEASE AGREEMENT

This Sublease Agreement (the "Sublease") is made on [date] between [Tenant name] (the "Tenant") and [Subtenant name] (the "Subtenant"), with the consent of [Landlord name] (the "Landlord").

1. Master lease

The Tenant rents the property at [full address and unit] (the "Property") from the Landlord under a lease dated [date] that ends on [end date] (the "Master Lease"). A copy of the Master Lease is attached. The Subtenant has read it.

2. Sublease

The Tenant subleases to the Subtenant [the entire Property / the bedroom described as description, with shared use of common areas] for the term in clause 3.

3. Term

The Sublease starts on [start date] and ends on [end date], which is no later than the end of the Master Lease.

4. Rent

The Subtenant pays [amount] USD per month to [the Tenant / the Landlord directly], due on the [1st] by [method]. The Tenant remains responsible to the Landlord for the full rent under the Master Lease.

5. Deposit

The Subtenant pays the Tenant a deposit of [amount], returned less lawful deductions with a written list within the time the law requires after the Sublease ends.

6. Utilities

7. Following the Master Lease

The Subtenant will follow all the rules of the Master Lease, including rules on pets, noise, guests and smoking. The Subtenant will not do anything that would put the Tenant in breach of the Master Lease.

8. Condition of the Property

The parties will record the condition of the Property at move-in with dated photos. The Subtenant returns it in the same condition, except normal wear and tear.

9. Furniture

10. No further subletting

The Subtenant may not sublet or assign this Sublease.

11. Ending early

If the Master Lease ends for any reason, this Sublease ends at the same time. The Tenant will tell the Subtenant promptly of any notice from the Landlord.

What the law says

Whether you can sublet depends on your lease and your state. Many leases forbid subletting without written consent. Some states and cities let a tenant sublet if the landlord refuses consent without a good reason. Check both before you sign.

In a sublease the original tenant stays bound to the landlord. If the subtenant does not pay or damages the unit, the landlord can look to the tenant. That is why clause 4 and 7 tie the subtenant to the master lease.

The ESIGN Act gives electronic signatures the same effect as ink. The tenant, the subtenant and the landlord can each sign from their phones.

Getting the landlord’s consent

Ask in writing and early. Share who the subtenant is, the dates and the rent. Offer to send their application or references.

Add the landlord as a signer of this document. Their consent sits in the last signature block, and everyone keeps the same PDF.

Protecting yourself as the tenant

  • Meet the subtenant and check references.
  • Collect a deposit that covers at least one month.
  • Take dated photos of every room before you leave.
  • Ask for rent a few days before your own rent is due.
  • Keep the landlord’s contact details for the subtenant.

A worked example

Olivia has a lease until next summer but takes a six-month job abroad. Her landlord agrees in writing to a sublease.

Noah rents the apartment from January to June at the same rent. He pays Olivia on the 25th and she pays the landlord on the 1st. In July Olivia returns, inspects the unit with the photos and returns Noah’s deposit.

Mistakes to avoid

  • Subletting without consent. It can breach your lease and end it.
  • A sublease that runs past your lease. Clause 3 keeps the end date inside the master lease.
  • Charging more than your rent. Some places limit this. Check before you set the price.

Signing with three parties

Add the tenant, the subtenant and the landlord as signers in that order. Each one signs from a phone with the brown bar at the bottom. The signed PDF and its certificate go to all three.

Checklist before you send it

  1. 1Attach a copy of the master lease.
  2. 2Check that the end date is inside your own lease.
  3. 3Confirm who receives the rent and on what day.
  4. 4Agree the deposit and how it comes back.
  5. 5Add the landlord as the third signer.

Once all three signatures are in, give the subtenant the keys and the building contacts.

When the subtenant leaves

Inspect the unit with the move-in photos. Return the deposit, less any damage, within the legal deadline. Tell the landlord the sublease has ended.

If the subtenant wants to stay after you return, they need a new lease with the landlord. A sublease cannot run past your own lease.

Furnished subleases

Many subleases come furnished. List the furniture and appliances in Schedule A and photograph them. Agree who replaces anything that breaks during the sublease.

A clear list avoids arguments about a broken lamp or a missing chair when the subtenant moves out.

Is a sublease signed online legally binding?

Yes. The ESIGN Act gives an electronic signature the same legal effect as a handwritten one. The signed PDF and its certificate show who signed the sublease, when and from which device.
