Breaking a lease: legal reasons, costs and how to do it right

Reviewed in October 2026

Breaking a lease means moving out before the end date your lease sets. You may owe rent until the landlord finds a new tenant, plus any early termination fee in the lease. Some reasons, like active military duty, let you leave without that cost.

Active military duty

The Servicemembers Civil Relief Act lets a servicemember end a residential lease after entering active duty, or after receiving orders for a permanent change of station or a deployment of 90 days or more.

The tenant gives written notice with a copy of the orders. For a lease paid monthly, the termination takes effect 30 days after the next rent due date.

Domestic violence

Many states let survivors of domestic violence, sexual assault or stalking end a lease early. They usually ask for written notice and a document such as a protective order or a police report.

A unit that is not habitable

Landlords must keep homes fit to live in. If there is no heat, no water or a serious health hazard, and the landlord does not fix it after notice, many states treat the lease as broken by the landlord.

Harassment or illegal entry

A landlord who enters without proper notice, changes the locks or cuts utilities to push a tenant out may break the lease first. Keep records of each event.

What it costs to break a lease

Without a legal reason, you owe what the lease says. That usually means rent until the end date, minus any rent the landlord collects from a new tenant.

Most states require the landlord to make reasonable efforts to re-rent the unit, called the duty to mitigate. The landlord cannot let the unit sit empty and bill you for the whole term.

  • Unpaid rent until a new tenant moves in.
  • An early termination fee, if the lease has one.
  • Reasonable costs to advertise and re-rent.
  • Repairs beyond normal wear and tear.

The landlord may take these from your security deposit and must send you an itemized list within the time your state sets.

How to break a lease, step by step

  1. 1Read your lease. Look for an early termination clause, notice periods and rules on subletting.
  2. 2Check your state law. See if military, safety or habitability rules apply to you.
  3. 3Talk to your landlord early. Many prefer a clean exit to an empty unit.
  4. 4Offer a replacement tenant. A qualified applicant can end your liability fast.
  5. 5Put the agreement in writing. Use a lease termination agreement signed by both.
  6. 6Give written notice. Send a lease termination letter with your move-out date.
  7. 7Document the unit. Take photos and do a walk-through when you leave.

What to write in your notice

A lease termination letter states your name, the address, the lease date, your move-out date and the reason, if it is a legal one. Add your forwarding address for the deposit.

  1. 1Opening. Dear [landlord name], this letter is my notice that I will end my lease for [address], dated [lease date].
  2. 2Move-out date. I will move out and return the keys on [date].
  3. 3Reason. I am ending the lease under [clause or law, for example the early termination clause in section (number)].
  4. 4Deposit. Please send my security deposit and any itemized deductions to [forwarding address].

How to sign a lease termination agreement online

Upload a lease termination agreement to SignSolú or start from a template. Add each signer with a name and a phone number or email.

Each signer gets a link by WhatsApp or email. On a phone they tap the brown bar at the bottom that says «Sign as …».

They draw their signature once with a finger and press «Sign and Send». Every place in the document that needs it gets filled.

A line next to that button records their consent to sign electronically, with a link to the disclosure.

The signed PDF ends with an audit certificate. It shows each signer, the time, the IP address and a SHA-256 hash of the file.

Make an online signature once and use the PNG on any PDF, contract or email. It is free and needs no account.

A tenant notice and a termination agreement can be signed electronically. Under 15 U.S.C. 7003, a landlord notice of default or eviction on a primary residence still goes on paper.

Breaking a lease as a landlord

A landlord cannot end a fixed-term lease early just by choice. The landlord needs a legal ground, such as unpaid rent or a serious violation, and must follow the state eviction process.

When both sides want to end the lease, a signed agreement with the move-out date and the deposit terms closes it cleanly.

An example

Kim has eight months left on her lease when she gets a job in another city. Her lease has no termination clause. She calls her landlord, offers to find a new tenant and agrees to pay one month of rent if the unit stays empty.

A friend of a coworker applies and is approved. Kim and the landlord sign a lease termination agreement from their phones. She moves out on the 30th with her full deposit back.

People also ask

Is it better to break a lease or sublet?

Subletting keeps rent coming in, but you usually stay liable if the subtenant fails to pay. Ending the lease by agreement is cleaner when the landlord accepts it.

Can I break a lease if my rent goes up?

Not during a fixed term, since the rent is set by the lease. At renewal you can decline the new rent and move out at the end date.

Does breaking a lease hurt your credit?

Breaking a lease is not reported by itself. Unpaid rent that goes to a collection agency can be reported and lower your score.

How much does it cost to break a lease?

It depends on the lease and the state. Without a legal reason, expect rent until the unit is re-rented, plus any fee your lease sets.

Can I break my lease if I buy a house?

Only under your lease terms or an agreement with the landlord. Buying a house is not a legal reason by itself.

Can a landlord charge for the full lease if I leave early?

In most states, no. The landlord must try to re-rent, and you owe only the rent lost until then.

Can I break a lease for mental health reasons?

Some disabilities can support a request for a reasonable accommodation. Talk to the landlord and a local tenant group.

Common mistakes when breaking a lease

  1. 1Moving out without notice. The landlord can charge rent while the unit sits empty before anyone knows it is free.
  2. 2Agreeing by phone only. Without a signed agreement, the landlord can change the deal later.
  3. 3Skipping the walk-through. Without photos, damage claims become your word against theirs.
  4. 4Not giving a forwarding address. The deposit refund and the itemized list have nowhere to go.
  5. 5Ignoring the lease clause on subletting. A sublet without consent can be a new breach.

Checklist before you move out

  • Signed termination agreement or written notice sent, with proof of delivery.
  • Final rent paid through the agreed date.
  • Utilities transferred or closed on the move-out date.
  • Photos and a video of every room, with the date.
  • Keys returned and a receipt for them.
  • Forwarding address given in writing.
