Release of lien: how to clear a lien from a property, a car or a project
Reviewed in October 2026
A release of lien is a document in which the lienholder states that a debt is paid and gives up its claim on the property. It is used when a car loan is paid off, a mortgage is satisfied or a contractor is paid on a construction project.

Three common kinds of lien release
| Kind | Who signs | Where it goes |
|---|---|---|
| Vehicle lien release | The lender that financed the car | Motor vehicle agency, to get a clean title |
| Mortgage release or satisfaction | The mortgage lender | County recorder |
| Construction lien release | Contractor, subcontractor or supplier | Owner or general contractor, and the county if a lien was filed |
| Judgment or tax lien release | The creditor or the tax authority | County recorder |
What a mechanic lien is
A mechanic lien is a claim by law on a property to secure payment for labor, materials or services that improved it. It arises from the law, not from the contract, and a properly perfected lien runs with the land, as the Legal Information Institute explains.
It goes by many names, such as construction lien, materialman lien or supplier lien. The release is how the person who could claim it confirms they were paid.
Conditional and unconditional releases
| Release | Effective when | Use it |
|---|---|---|
| Conditional progress | The payment named clears | With each progress payment, before it clears |
| Unconditional progress | On signing | After a progress payment has cleared |
| Conditional final | The final payment clears | With the last payment, before it clears |
| Unconditional final | On signing | After the final payment has cleared |
A contractor should never sign an unconditional release before the money is in the bank. Once signed, it waives the right to lien for that amount even if the check bounces.
Some states publish statutory release forms that must be used word for word. California and Texas are two of them. In those states, use the official form instead of a general template.
How to release a lien on a car
- 1Pay off the loan and keep the final statement.
- 2The lender sends a lien release letter or signs the release on the title.
- 3If the state keeps electronic titles, the lender releases the lien electronically.
- 4Take the release to the motor vehicle agency to get a clean title in your name.
If the lender does not send the release after payoff, ask in writing. Many states set a time limit for lenders to release a paid lien.
How to release a lien on real estate
- 1Confirm the amount owed and pay it.
- 2Ask the lienholder for a signed release, usually notarized.
- 3Record the release with the county recorder where the lien was recorded.
- 4Get a copy of the recorded release for your files and your title company.
Release of lien template
This is a general unconditional final release. Use it after the payment has cleared. In states with statutory forms, use the official form.

How to sign a lien release online
Upload a lien release to SignSolú or start from a template. Add each signer with a name and a phone number or email.
Each signer gets a link by WhatsApp or email. On a phone they tap the brown bar at the bottom that says «Sign as …».
They draw their signature once with a finger and press «Sign and Send». Every place in the document that needs it gets filled.
A line next to that button records their consent to sign electronically, with a link to the disclosure.
The signed PDF ends with an audit certificate. It shows each signer, the time, the IP address and a SHA-256 hash of the file.
If the other side sends their own PDF form instead, fill in the PDF form online, add the date and your signature, and download it.
Releases exchanged between contractors and owners can be signed electronically. A release that goes to the county recorder usually needs a notary, and many recorders accept electronic recording.
An example
A roofing company finishes a USD 18,000 job. With the final invoice it sends a conditional final release. When the owner payment clears, it sends an unconditional final release signed from the office manager phone.
The owner now has proof the roofer will not file a lien. When the owner sells the house, the title company sees a clean record.
People also ask
Can I sell a car with a lien on it?
Yes, but the lien must be paid at or before the sale, usually from the buyer money, so the buyer gets a clean title.
What is a partial release of lien?
A release that frees part of the property, or part of the amount, while the rest of the lien stays in place.
What is a lien release letter?
A letter from a lender confirming that a loan is paid and the lien on the vehicle or property is released. Motor vehicle agencies often accept it to issue a clean title.
Can a contractor file a lien after signing a release?
Not for the amount the release covers. A partial or progress release still lets the contractor lien for unpaid later work.
How do I find out if there is a lien on my property?
Search the records of the county recorder, or order a title report. For a vehicle, check the title or the state motor vehicle records.
What is a satisfaction of mortgage?
The document a mortgage lender signs and records when the loan is paid in full. It works as the release of the mortgage lien.
How long does a lien release take?
For a car, often a few weeks after payoff. For real estate, it depends on how fast the lienholder signs and the county records it.
Who files a release of lien?
Usually the lienholder, or the owner with the signed release. Check who your county lets record it.
Is a lien waiver the same as a lien release?
They are close. A waiver gives up the right to file a lien, often before one exists. A release cancels a lien or the right to it after payment.
What happens if a lien is not released?
The property may not sell or refinance cleanly. The owner can demand the release and, in many states, go to court.
Does a lien release need to be notarized?
If it will be recorded, almost always. Releases exchanged on a project often are not.
Common mistakes with lien releases
- 1Signing unconditional before payment clears. The right to lien is gone even if the check bounces.
- 2Wrong property description. The county cannot match the release to the lien.
- 3Not recording. The lien stays on the title even though the debt was paid.
- 4Ignoring subcontractors. The general contractor is paid but a supplier can still lien.
- 5Using a general form where a statutory form is required. The release may not work.
Lien releases on a construction project
Owners and lenders often ask for a release with every payment. The general contractor collects releases from its subcontractors and suppliers and passes them on with its own.
On a busy project that means dozens of releases a month. Sending each one from a template and getting it signed from a phone keeps the payment cycle moving.
