How it gets signed
1Choose “Use this template”, fill in the fields and read the full termination letter once more.
2Send it by WhatsApp or email. The other party opens the link on their phone without an account.
3They tap the brown bar at the bottom that says “Sign as …” and draw their signature with a finger.
4Everyone gets the signed PDF with its signature certificate. Anyone can check it at signsolu.com/verificar.
Before signing, each signer agrees to sign electronically. The screen links to the electronic signature disclosure the ESIGN Act asks for.
The employee’s signature only confirms they received the letter. The letter is effective even if they decline to sign. Keep the certificate that shows when it was sent and opened.
Your first ten documents are free and need no card.
Most US jobs are at will, so a reason is not always required. If you give one, it must be true and lawful. A firing based on race, sex, age, disability, religion or a protected complaint breaks federal law.
Final paycheck deadlines vary by state. Some states require payment on the last day. Others allow the next regular payday. Check your state before you write clause 3.
The ESIGN Act gives the electronic signature the same effect as ink. The certificate records when the employee received and signed the letter.
Before you send a termination letter
1Review the employee’s file and any written warnings.
2Check the final paycheck deadline in your state.
3Confirm the end date of health coverage with your plan.
4Plan the meeting. The letter follows a conversation, it does not replace it.
5Prepare the list of property to return and the time access ends.
How much to say about the reason
Keep it short and factual. Option A works for layoffs. Option B works when there were documented warnings. Option C states the at-will basis without details.
Never write something you cannot prove. The letter may be read later by an agency or a court.
Receipt is not agreement
The employee signs to show they got the letter. The signature block says so in plain words. That avoids a common fight at the end of the meeting.
A worked example
Northside Furniture closes one sales position. The manager meets Tyler on Tuesday and explains the decision.
Right after the meeting, HR sends the letter. Tyler signs it on his phone to confirm receipt. His final pay arrives Friday by direct deposit, as clause 3 says.
Common mistakes
Late final pay. Some states charge penalties for each day late.
Vague reasons. “Not a good fit” invites questions. Choose a clear option.
Forgetting access. Turn off email and systems at the agreed time.
No record of delivery. The certificate shows when the letter was sent and signed.
Larger layoffs can trigger extra notice rules. The federal WARN Act covers certain plant closings and mass layoffs at larger employers, and some states have their own versions.
If you are ending many jobs at once, check those rules before you set dates.
What to say in the meeting
Say the decision clearly in the first minute.
Explain the reason in one or two sentences.
Walk through final pay, benefits and property return.
Give the letter and answer practical questions.
Keep the meeting short and private.
The letter repeats what you said. It gives the employee the dates and contacts in writing.
Records to keep
Keep the signed letter, the certificate and the final pay record together. If the employee files for unemployment or a claim, those papers answer most questions.
Sample lines for common situations
Layoff: “Your position is being eliminated as part of a reduction in staff. This decision is not related to your performance.”
After warnings: “As discussed in our meetings of August 4 and September 15, attendance did not improve as required.”
End of a temporary job: “Your temporary assignment ends on October 31, 2026, as stated in your offer letter.”
Paid time off: “Your final paycheck includes 6 days of accrued, unused paid time off.”
Reference: “If future employers contact us, we will confirm your dates of employment and job title.”
Use one reason line only. Add the practical lines that apply and keep the letter to one page.
Checklist before you send the letter
1The separation date is correct and matches payroll.
2The final paycheck date meets your state’s deadline.
3The benefits end date matches the plan rules.
4The list of property is complete.
5A second manager or HR has read the letter.
Send it from the company account so the certificate shows the company as sender. Keep the signed copy in the employee file.
If the employee works remotely, hold the meeting by video and send the letter right after. They sign to confirm receipt from their phone, and you have the date on record.
State the employee’s name, the last day of work and the reason if you give one. Then explain final pay, benefits such as COBRA, and the return of company property. Keep it short and factual, sign it and hand it over in the meeting.
Is a termination letter signed online legally binding?
Yes. The ESIGN Act gives an electronic signature the same legal effect as a handwritten one. The signed PDF and its certificate show who signed the termination letter, when and from which device.
Does the employee need a SignSolú account to sign?
No. They open the link on their phone and sign with the brown bar at the bottom of the screen.
Can I download the termination letter in Word?
Yes. “Download in Word” gives you the full termination letter with no email and no account. You can print it or edit it and sign it here later.
Do I have to give a reason in the letter?
Not in most at-will jobs. If you give one, keep it true, short and lawful.
What if the employee refuses to sign?
The termination still takes effect. The certificate shows the letter was sent and opened.
Should I offer a severance agreement?
You may. A severance agreement with a release is a separate document with its own legal rules.
When should the employee receive the letter?
At the end of the meeting or right after it. Do not send it before you talk to the employee.
