Reviewed in October 2026

An employment contract is a written agreement between an employer and an employee. It sets the job, the pay, the hours, the benefits and how the job can end. In most US states employment stays at will unless the contract says otherwise.

EMPLOYMENT AGREEMENT

This Employment Agreement (the "Agreement") is made on [date] between [Employer name], with address at [address] (the "Employer"), and [Employee name], with address at [address] (the "Employee").

1. Position and duties

The Employer employs the Employee as [job title], reporting to [manager title]. The Employee’s main duties are [list of duties]. The Employer may assign other reasonable duties that fit the role.

2. Start date and place of work

Employment starts on [start date]. The Employee will work at [address / remotely / hybrid, with days at the office].

3. Hours

The regular schedule is [days and hours], for a total of [40] hours per week. The position is [exempt / non-exempt] under federal and state wage laws. If non-exempt, the Employee will be paid overtime as the law requires and must have overtime approved in advance.

4. Pay

The Employer will pay [amount] per [hour / year], less lawful withholdings, on a [weekly / biweekly / semimonthly] schedule by direct deposit or check.

5. Benefits

The Employee is eligible for [health insurance, retirement plan and other benefits] under the terms of each plan. The Employee will receive [number] days of paid time off per year and [number] paid holidays, plus any paid sick leave the law requires.

6. Probation

The first [90] days are an introductory period for both parties to review the fit. Completing it does not change the at-will nature of employment.

7. Confidentiality

The Employee will keep the Employer’s non-public information private during and after employment and return all company property on leaving.

Under 18 U.S.C. 1833(b), an individual is immune from liability under trade secret law for disclosing a trade secret in confidence to a government official or an attorney solely to report or investigate a suspected violation of law, or in a court filing made under seal.

8. Work product

Work the Employee creates within the scope of the job belongs to the Employer to the extent the law allows.

9. At-will employment

Employment is at will. Either party may end it at any time, with or without cause or notice. The Employer asks for [two weeks’] notice from the Employee as a courtesy. Only a written agreement signed by [title] can change the at-will status.

10. Policies

The Employee will follow the Employer’s written policies, as updated from time to time. If a policy conflicts with this Agreement, this Agreement prevails.

11. Eligibility to work

This offer depends on the Employee completing Form I-9 and showing documents that prove identity and authorization to work in the United States.

12. General terms

This Agreement is governed by the laws of [state]. It is the entire agreement on its subject. The parties agree to sign electronically, with the same effect as a handwritten signature.

What the law says

Most US jobs are at will. Either side can end them at any time for any lawful reason. A written contract can change that, so clause 9 says plainly that the job stays at will.

Federal law sets the minimum wage and overtime rules. Many states and cities set higher minimums, paid sick leave and their own pay-day rules. Check your state labor department before you fill in clauses 3 to 5.

Every new hire must complete Form I-9 to confirm identity and work authorization. The employer must review the documents by the third business day of work.

The ESIGN Act lets both sides sign the contract electronically, with the same effect as ink.

Do you need a written employment contract?

No federal law requires one for most jobs. But a signed contract avoids the classic arguments. Pay, hours, paid time off and duties are all on paper from the first day.

It also helps with benefits, overtime and the end of the job. A clear exempt or non-exempt line in clause 3 avoids costly wage claims.

Contract, offer letter and handbook

DocumentWhat it doesWhen to send it
Offer letterMakes the offer and its key termsBefore the candidate accepts
Employment contractSets the full terms of the jobAfter acceptance, before day one
Confidentiality agreementProtects company informationWith the contract
HandbookDaily rules and policiesOn the first day

Many small employers send the offer letter first and this contract once the candidate says yes.

Exempt or non-exempt

Non-exempt employees earn overtime for hours over 40 a week. Exempt employees do not, but they must meet salary and duties tests. A job title alone does not make a role exempt.

When in doubt, treat the role as non-exempt and track hours. Mistakes here are among the most common wage claims.

A worked example

Cedar Ridge Veterinary Clinic hires Alicia as a technician at 24 USD an hour. She is non-exempt, so overtime is paid after 40 hours.

The clinic sends the contract with the confidentiality agreement on Thursday. Alicia signs both from her phone that night. On Monday she brings her I-9 documents and starts work.

Signing with a new hire

Send the contract after the offer is accepted and before the first day. The employee signs from a phone with the brown bar at the bottom. Both keep the signed PDF in their records.

Remote and hybrid employees

Write the work location in clause 2, even for remote roles. The state where the employee works usually decides which wage and leave laws apply.

If the employee moves to another state, review the contract. Pay day rules, sick leave and tax withholding can all change.

Updating the contract

Raises, new titles and new schedules happen. Record each change in a short signed amendment or a new contract. Keep every signed version in the employee file.

Frequently asked questions

What should an employment contract include?

The job title and duties, start date, pay and pay schedule, hours, benefits, whether the job is at will, confidentiality, and how either side can end it. This template has a clause for each, ready to edit for full-time or part-time roles.

Is an employment contract signed online legally binding?

Yes. The ESIGN Act gives an electronic signature the same legal effect as a handwritten one. The signed PDF and its certificate show who signed the employment contract, when and from which device.

Does the new employee need a SignSolú account to sign?

No. They open the link on their phone and sign with the brown bar at the bottom of the screen.

Can I download the employment contract in Word?

Yes. “Download in Word” gives you the full employment contract with no email and no account. You can print it or edit it and sign it here later.

Does an employment contract end at-will employment?

Only if it says so. This template keeps the job at will in clause 9.

Can I use this template for part-time employees?

Yes. Write the weekly hours in clause 3 and adjust benefits in clause 5 to what part-time staff receive.

Can I sign the I-9 electronically too?

The I-9 has its own federal rules for electronic signatures. Keep it as a separate process from this contract.

How long should I keep the signed contract?

Keep it for the whole job and several years after it ends. Payroll and personnel records have their own legal retention periods.
