MASSACHUSETTS MOTOR VEHICLE BILL OF SALE

6. Plates

The Seller keeps the license plates and cancels or transfers the registration. The Buyer registers the vehicle in the Buyer's name.

7. Responsibility After Delivery

From the date and time of delivery, the Buyer is responsible for the property, its use, taxes, registration, insurance and any fines or tolls. The Seller remains responsible for anything that happened before delivery.

8. Odometer Statement

The Seller states that the odometer now reads [miles] miles and, to the best of the Seller's knowledge, reflects the actual mileage [unless marked: exceeds mechanical limits / is not the actual mileage].

What the law says

Massachusetts General Laws chapter 90D, section 15 sets how a titled vehicle changes hands. At delivery, the owner signs the assignment on the certificate of title, with the actual odometer reading and a warranty of title. The buyer then applies for a new certificate of title promptly.

The bill of sale works alongside the title. It records the price and the terms, which the RMV uses for sales tax.

Massachusetts has its own lemon laws for used cars sold by dealers and, in some cases, by private sellers. Read them on the state's official sites before you set the warranty in clause 4.

The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.

Selling a car privately in Massachusetts

Keep a copy of the signed bill of sale and a photo of the signed title. They prove the date the car left your hands.

Buying a car privately in Massachusetts

Why the price on the bill of sale matters

The state collects sales tax on private vehicle sales. The price on the bill of sale is what the buyer reports.

Write the real price. A false low price can cause problems for both parties and the state may tax on a standard value instead.

Gifts between family members can have different tax treatment. Write «gift» and the relationship if that is the case.

Common mistakes

Letting the buyer drive on your plates. Plates stay with the seller in Massachusetts.

Missing odometer reading. It is required on the title assignment. Write the same number in the bill of sale.

Selling with a lien. The buyer cannot get a clean title until the lender releases it.
