What the law says

RCW 46.12.650 sets the steps for a vehicle sale in Washington. The seller signs the release of interest on the title, gives the title to the buyer, provides an odometer disclosure if required and reports the sale.

The report of sale must reach the Department of Licensing or an agent within five business days after the sale. It includes the date, both names and addresses, the VIN and the plate.

The buyer who does not apply for a new title within 15 calendar days of delivery pays a penalty. Failing to apply within 45 days is a misdemeanor under the same section.

The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.

Why the report of sale protects the seller

Until the state knows you sold the car, it is still yours on record. Tickets, tolls and towing bills can land on you.

File the report of sale within five business days. The state lets owners do it electronically.

Keep the signed bill of sale with the report. Together they show the exact date and time the car changed hands.

Step by step for the seller

  1. 1Pay off any loan and get the lien release.
  2. 2Fill in and sign the bill of sale with the buyer.
  3. 3Sign the release of interest on the title and hand it over.
  4. 4Give the odometer disclosure if the vehicle needs one.
  5. 5File the report of sale within five business days.

Step by step for the buyer

  1. 1Check that the VIN matches the car, the title and the bill of sale.
  2. 2Insure the vehicle before you drive it.
  3. 3Apply for a new title within 15 calendar days with the signed title and the bill of sale.
  4. 4Pay the use tax and fees when you transfer the title.

Common mistakes

Skipping the report of sale. Without it, the seller may get the buyer's parking tickets.

Waiting to transfer the title. After 15 days the penalty starts, and after 45 days it becomes a misdemeanor.

A different address on each document. Use the same full address in the bill of sale, the title and the report.

Signing the bill of sale online

Fill in the bill of sale on your phone while the buyer looks at the car. Send the link, and both of you sign in a minute.

The signed PDF shows the date and time of each signature. That is the moment you write in the report of sale.

Sellers who sell to out-of-state buyers still file the Washington report of sale. The buyer then follows the rules of their own state.
