What the law says
States treat ATVs very differently. Some issue titles, some only register them for trail use, and some do neither for off-road use on private land.
Where there is no title, the bill of sale and the manufacturer's certificate of origin are the usual proof of ownership. Keep both in a safe place.
Check the VIN against stolen vehicle databases before you pay. ATVs are frequently stolen and resold without paperwork.
The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.
When the ATV has no title
Buyers worry when there is no title. In many states that is normal for ATVs.
Ask for the registration card, the certificate of origin and any purchase receipts from the original owner. Together with the bill of sale, they show a clean chain.
Clause 5 records which papers the seller delivered. Write them down at the moment of the sale.
What to check before you buy
VIN. Usually on the frame near the front. Match it with the paperwork.
Hour meter. High hours mean more wear on the engine and drivetrain.
Frame and suspension. Look for cracks, welds and bent parts.
CV boots and axles. Torn boots let dirt in.
Test ride. Shift through every gear and test the brakes.
Paying and handing over
Cash is common for smaller sales. For larger amounts, a bank transfer or cashier's check leaves a record.
Sign the bill of sale before the ATV leaves. Both of you can sign from your phones in the seller's driveway.
Take a photo of the buyer's ID and the ATV with the buyer. It closes the record on the seller's side.
Registering the ATV after the sale
Most states ask the new owner to register within a short period. Bring the bill of sale and any title or registration.
Trail permits are often separate from registration. Check the rules where you plan to ride, since state land and private trail systems can each ask for their own.
Common mistakes
Buying without a VIN check. A stolen ATV can be seized from the new owner.
Forgetting accessories. List the winch, plow and trailer, or the buyer may not get them.
Selling to a minor. Use an adult buyer's name on the bill of sale.
Selling an ATV with a trailer
ATVs often sell with the trailer that hauls them. Trailers have their own VIN and are titled or registered in many states.
List the trailer in clause 1 with its VIN, or sign a separate bill of sale for it. The buyer will need to register it apart from the ATV.
Write a separate price for the trailer if your state taxes it differently. That keeps the tax office from guessing.
Hand over the keys, the papers and any spare parts together. A list of what the buyer received closes the deal cleanly.
Before you sign
Read every clause of the ATV bill of sale with the other party before anyone signs. Change what does not fit your deal.
