A horse bill of sale records the sale of a horse from one owner to another. It describes the horse, lists its registration and health records, and sets the price and the date. It also says whether the horse is sold as is or with any promise about health or use.

What the law says
A horse is sold as goods under Article 2 of the Uniform Commercial Code in each state. Unless the parties agree otherwise, implied warranties can apply. «As is» language removes most of them.
Many states require a negative Coggins test, a test for equine infectious anemia, for a change of ownership or for moving a horse across state lines. Ask your state veterinarian's office before the sale.
Breed registries have their own transfer rules and forms. The bill of sale does not replace the registry transfer.
The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.
Describing the horse so there is no doubt
Many horses look alike. Use the registered name, the barn name, color, markings and a microchip or brand if there is one.
Attach photos of both sides and the face. Registries and insurers ask for them too.
Write the foaling date, not only the age. Ages change every year and dates do not.
The pre-purchase exam
A pre-purchase exam by a veterinarian the buyer chooses is the best protection for the buyer. It can include flexion tests, X-rays and blood work.
If the buyer skips it, clause 6 records that choice. It prevents disputes about what the buyer knew.
Sellers should disclose known vices, injuries and medications in clause 5. Honest disclosure is the seller's best defense.
Trial periods and returns
Some sales include a trial period at the buyer's barn. Write a separate trial agreement with the dates, insurance and who pays for care.
If the horse can be returned, say within how many days and in what condition. Without that clause, the sale is final.
Common mistakes
Missing Coggins. Many shows and states will not accept a horse without a current negative test.
Promises not in writing. «He is great for beginners» becomes a fight if the horse bucks. Write any promise into clause 4 or leave it out.
No registry transfer. Without the papers, the buyer cannot show or register foals in the horse's name.
Signing at the barn
Horse sales usually close at the barn. Fill in the bill of sale on your phone while the horse is loaded.
The buyer signs from their phone. Both of you leave with the signed PDF and its certificate.
Buyers from out of state often arrange transport separately. Sign the bill of sale before the hauler arrives, so the horse leaves with its papers.
Ask the hauler what documents they need for the trip. Interstate transport often needs a health certificate as well as the Coggins.
Before you sign
Read every clause of the horse bill of sale with the other party before anyone signs. Change what does not fit your deal.
