What the law says

Land leases are governed by state real property law. Leases longer than one year usually need to be in writing and signed to be enforced.

Long ground leases are often recorded with the county so lenders and buyers see them. Recording offices may ask for a notarized memorandum of lease.

Farm leases have special rules in some states, such as notice deadlines to end a year-to-year lease. Check your state before the term ends.

The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.

Common types of land leases

  • Farm and pasture leases for crops or grazing.
  • Ground leases where the tenant builds a store, office or warehouse.
  • Mobile home lot leases in parks or on private land.
  • Storage and parking leases for vehicles, boats or equipment.
  • Hunting leases for seasonal access.

The template fits all of them. Clause 2 and clause 6 are where they differ most.

Cash rent or crop share

In a cash rent lease, the farmer pays a fixed amount per acre. The landowner gets a steady income with no crop risk.

In a crop share lease, the landowner receives a share of the harvest and pays a share of some costs. Income rises and falls with the crop.

This template uses cash rent. Replace clause 4 if you agree on a crop share.

Who owns what is built on the land

Ground leases often run for decades because the tenant builds something expensive. The end of the lease decides who keeps the building.

Clause 6 gives three choices. The building passes to the landowner, the tenant removes it, or the landowner buys it.

Lenders financing the building will read this clause closely. Settle it before the tenant applies for a loan.

Common mistakes

No map. Acreage without boundaries leads to disputes. Attach a map or survey as Exhibit A.

Ignoring other rights. Mineral, water and hunting rights can be worth more than the rent. Say who keeps them.

No environmental rule. Contamination stays with the land. Clause 7 makes the tenant responsible for what it brings.

Missing renewal deadline. A renewal option without a notice date creates doubt. Clause 3 asks for written notice by a set date.
