How it gets signed

  1. 1Choose «Use this template», fill in the fields and review the full purchase agreement.
  2. 2Send it by WhatsApp or email. The other party opens the link on their phone without an account.
  3. 3They tap the brown bar at the bottom that says «Sign as …» and draw their signature once.
  4. 4Everyone gets the signed PDF with its signature certificate. Anyone can check it at signsolu.com/verificar.

The signing screen tells each signer that signing means agreeing to sign electronically. It links to the electronic signature disclosure that the ESIGN Act asks for.

What you get once everyone signs

  • The signed PDF. The final purchase agreement with every drawn signature in place.
  • The signature certificate. It lists each signer and the date and time of each signature.
  • A record you can check. The folio on the certificate opens the document history at signsolu.com/verificar.
  • Reminders. Turn them on and SignSolú reminds every signer who has not signed yet.

What the law says

A purchase agreement for land must be in writing and signed to be enforced. Every state has this rule in its statute of frauds. A handshake deal on a house does not bind anyone in court.

Some states publish a standard form that agents must use. Texas, California and others have forms from their real estate commission or Realtor association. Buyers and sellers without an agent can use their own written agreement.

The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.

The exceptions in 15 U.S.C. 7003 do not include real estate contracts. The deed that transfers the property is a separate document. Many county recorders still ask for a notarized deed.

When to use a purchase agreement

Sign it as soon as the buyer and the seller agree on price and terms. It locks the deal while the buyer gets the loan and the inspection.

  • For sale by owner. A seller without an agent sells a house to a buyer they found.
  • Family sale. Parents sell a rental property to one of their children.
  • Land. A buyer purchases a vacant lot to build a home.
  • Investor deal. An investor buys a property in cash with a short closing.

The contingencies that protect the buyer

A contingency lets the buyer cancel and get the deposit back if something fails. Each one needs a clear deadline.

Financing. The buyer can walk away if the loan is denied. Sellers prefer short deadlines and a preapproval letter.

Inspection. The buyer can cancel or ask for repairs after the inspection. Ten days is common for a home.

Appraisal. The buyer can cancel if the property appraises below the price. Add it in clause 3 when a lender is involved.

Sale of another home. The buyer needs to sell first. Sellers often accept it only with a backup offer clause.

How the earnest money works

The deposit shows the buyer is serious. It usually ranges from 1% to 3% of the price.

A title company or escrow agent holds it, never the seller directly. At closing it counts toward the price.

If the buyer cancels within a contingency, the deposit goes back. If the buyer walks away without a reason, the seller can keep it.

Common mistakes

No legal description. A street address alone can be unclear for land. Copy the legal description from the current deed.

Open deadlines. «As soon as possible» gives no one a date to enforce. Write a number of days for each step.

Missing items. Appliances, curtains and sheds cause fights at closing. List what stays and what goes.

One spouse signs. In many states both spouses must sign to sell a home. Add every owner on the title as a seller.

Frequently asked questions

Is a purchase agreement signed online legally binding?

Yes. The ESIGN Act gives electronic signatures the same effect as handwritten ones. The signed PDF and its certificate show who signed and when.

Does a purchase agreement transfer the property?

No. It is a promise to sell and buy. The property transfers at closing with a signed deed that gets recorded with the county.

Can I use this template without a real estate agent?

Yes. Buyers and sellers can sign their own written agreement. A title company can then handle the closing.

Can the buyer back out after signing?

Yes, within a contingency and its deadline. Outside of them the buyer may lose the earnest money.

Can I use it to sell something other than a house?

Yes. Change clause 1 to describe the goods or the asset. For a vehicle, a bill of sale is usually the better fit.

Does the other party need a SignSolú account?

No. They open the link on their phone and sign with the brown bar at the bottom.

Can I edit the clauses before sending it?

Yes. After «Use this template» you can change any clause before you send it.
