What the law says
Each state decides how RVs are titled and registered. Motorhomes are titled like other motor vehicles. Many states also title travel trailers and fifth wheels above a certain weight.
Federal law requires an odometer disclosure when most motor vehicles change hands. For a motorhome, the seller writes the mileage on the title or on a disclosure form. Clause «Odometer Statement» records it in the bill of sale too.
The bill of sale does not replace the title. The seller signs the title over to the buyer, and the buyer applies for a new title and pays any sales tax.
The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.
Why you need a bill of sale for an RV
The title proves ownership. The bill of sale proves the deal, with the price, date and condition.
Many DMVs ask for a bill of sale to calculate sales tax. Some require it for trailers that have no title.
It also protects the seller. If the buyer gets a ticket before registering, the bill of sale shows the date the RV changed hands.
Inspecting a used RV before you buy
Roof and seals. Water damage is the most expensive problem in an RV.
Slide-outs and awning. Run them out and back in.
Generator, water heater and furnace. Start each one.
Tires. Check the date code. RV tires age out before they wear out.
Engine and chassis on a motorhome, with a mechanic if you can.
Write any known issue in clause 5. A disclosed problem rarely becomes a dispute.
Paying safely for an RV
RVs sell for tens of thousands of dollars. Meet at the buyer's bank and watch the cashier's check being issued, or wait until a bank transfer clears.
If there is a loan on the RV, pay the lender first and get the lien release. The buyer cannot get a clean title without it.
Hand over the keys and the signed title only after the money is in your account.
After the sale
1The seller signs the title over to the buyer and keeps a copy.
2The seller reports the sale to the DMV where the state allows it.
3The buyer applies for a new title and registration and pays any tax.
4The buyer insures the RV before driving or towing it away.
Common mistakes
Wrong VIN. One wrong digit stops the registration. Copy it from the title and check it on the vehicle.
Leaving out included items. A generator or hitch can be worth thousands. List what goes with the RV.
Selling with an open loan. The buyer cannot register an RV with a lien still on the title. Clear it at the sale.
Selling an RV to a buyer in another state
Out-of-state buyers are common for RVs. The buyer registers in their home state, under that state's rules.
Many buyers need a temporary permit to drive the RV home. Ask their DMV before the pickup date.
Signing online helps when the buyer flies in only for pickup. Everything is signed before they arrive, and the visit is just the inspection and the keys.
Before you sign
