What the law says

The Virginia DMV publishes form SUT 1, Vehicle Price Certification. Individuals use it to certify the purchase price of a vehicle more than five years old to obtain a title. The seller or the buyer signs it under penalty of perjury.

The buyer applies for title and registration with form VSA 17A and the assigned title. The DMV page on title transfers also explains its electronic titling program for private sales between Virginia residents.

The bill of sale is the private record of the deal. Make sure the price in it matches the price on SUT 1.

The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.

Common mistakes

Different prices on different papers. SUT 1 is signed under penalty of perjury. Use the real price everywhere.

Missing the lien release. The DMV will not issue a clean title while a lien shows on record.

Leaving plates on the car. Take them off before the buyer drives away.

Signing the bill of sale online

Print the signed PDF for the DMV if you go in person. The certificate on the last page shows when each party signed.
