What the law says
A lawn care agreement is a services contract under state law. It needs no special form, but a written one sets price and season clearly.
Pesticide application is regulated by each state. Many states require a license to apply pesticides for hire, and some require posted notices after treatment. Check your state agriculture department.
Automatic renewal clauses are regulated in several states. Some require a clear notice before renewal. Clause 8 states the renewal plainly for that reason.
The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.
Per visit, monthly or seasonal pricing
Per visit is easy to understand. Customers pay only when the crew comes.
Monthly spreads the season into equal payments. Customers like a fixed bill and the company gets steady cash flow.
Seasonal charges one price for the whole year, often with a discount for paying up front.
Clause 3 lets you pick one. Monthly pricing with a card on file is the easiest to collect.
Signing up customers for the season
Most lawn care companies sign their customers in late winter. Paper contracts mailed in February come back in April.
Send each customer a link by text or email. They sign from the phone in a minute, and you plan routes with real numbers.
Save your filled agreement as a template. For each new customer, change the address, the services and the price.
Residential or commercial properties
Commercial properties need more detail. Add snow removal, parking lot sweeping and response times if you offer them.
Property managers often ask for a certificate of insurance and a W-9. Have both ready before you send the contract.
HOAs may need board approval before signing. Send the contract to the board president and ask who else must sign.
Common mistakes
No season dates. Customers expect mowing until the grass stops growing. Put start and end dates in clause 2.
Extras without approval. Pruning a hedge that was not in the contract leads to unpaid invoices. Quote it first.
Hidden sprinkler heads. A broken head is a common complaint. Clause 5 asks the customer to mark them.
No late payment rule. Mowing for months without being paid adds up fast. Clause 4 lets you pause service.
Adding services during the season
Customers often ask for aeration, overseeding or a new flower bed in the middle of the season. Quote each one in writing.
For larger add-ons, send a short amendment with the new service and price. The customer signs it from the phone and the record stays with the original agreement.
Before you sign
Read every clause of the lawn care contract with the other party before anyone signs. Change what does not fit your deal.
