What the law says
The Mississippi Department of Revenue explains title transfers on its Motor Vehicle Titles page. The title must be assigned to the new owner, and the seller completes every section of the assignment except the buyer's printed name and signature.
The same page warns that leaving the buyer's name blank to complete later violates Mississippi law. When buyer and seller are close relatives, an Affidavit of Relationship should be completed.
The seller removes the license plate once the title is assigned and the vehicle is handed over. A standard title costs USD 9.00 and is usually issued within six weeks of a complete application.
The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.
Title assignment and bill of sale
The assigned title moves ownership in Mississippi. The bill of sale records the price, the date and the condition both sides agreed on.
Sign the bill of sale first, on your phones, before you meet to hand over the title. You arrive with the deal already written and signed.
Step by step for a private sale
1Agree on the price and fill in this template with the vehicle data.
2Both sign the bill of sale from their phones.
3The seller completes the title assignment, leaving no blank for the buyer's name.
4The seller removes the license plate and hands over the vehicle.
5The buyer applies for the new title with the state.
Common mistakes
Open titles. A title with the buyer's name left blank breaks state law and leaves the seller exposed.
Forgetting the plate. The plate stays with the seller in Mississippi. Take it off before the buyer drives away.
Skipping the affidavit. A sale between a parent and a child needs the Affidavit of Relationship. Mark clause 7 and attach it.
Fast Track and electronic titles
The Department of Revenue offers a Fast Track title for USD 39.00, issued within 72 hours of receipt. Electronic titles are issued in three to four weeks.
A buyer who needs the title quickly, for a loan or a resale, often pays for Fast Track. Plan the choice before the sale date.
Getting paid safely in a Mississippi private sale
Cash and cashier's checks are the usual choices. Meet at the buyer's bank when the amount is large, so the teller confirms the funds.
Do not hand over the title until the money is in your account. A signed bill of sale with the price paid protects the seller only after payment clears.
If the buyer pays by bank transfer, wait for the confirmation in your own banking app. Screenshots sent by the buyer are not proof of payment.
What the buyer should check before signing
The VIN on the dashboard, the door jamb and the title match.
The name on the title is the seller's name.
The title shows no open lien, or the seller has the lien release.
A mechanic you trust has looked at the vehicle.
A vehicle history report shows no salvage or flood record.
Once both sides are satisfied, send the bill of sale for signature. In Mississippi, buyer and seller usually sign the same day the keys change hands.
Is a Mississippi bill of sale signed online legally binding?
Yes. The ESIGN Act gives electronic signatures the same effect as handwritten ones. The signed PDF and its certificate show who signed and when.
How long does a Mississippi title take?
About six weeks for a standard title, according to the Department of Revenue. Fast Track titles are issued within 72 hours for a higher fee.
Who keeps the license plate?
The seller. The state asks the previous owner to remove it once the title is assigned.
Can I sign the title itself on my phone?
No. The title follows the state's own process, on paper or as an electronic title where the state offers one. The bill of sale is the document you sign here.
Does the other party need a SignSolú account?
No. They open the link on their phone and sign with the brown bar at the bottom.
Can I edit the clauses before sending it?
Yes. After «Use this template» you can change any clause before you send it.
