What the law says
The Indiana BMV explains when a bill of sale counts on its page Proof of Vehicle Ownership: Bill of Sale. A bill of sale cannot transfer ownership of a vehicle that requires a certificate of title by law.
When the BMV accepts it, the bill of sale must show the purchaser's name, the year, make and model, the VIN, the seller's signature and the seller's address. The BMV states that it does not need to be notarized.
The BMV also uses a bill of sale to fill in a missing sale date or price on a title. It cannot override what is already written on the title.
The ESIGN Act, 15 U.S.C. 7001 gives an electronic signature the same legal effect as one on paper. A contract cannot be denied effect only because it was signed electronically.
State differences
The BMV lists cases where a bill of sale, its State Form 44237 or a similar document, works as proof of ownership. They include vehicles not required to be titled, sheriff's sales, utility trailers bought before January 1, 1990, and pop-up trailers bought before July 1, 2016.
In those cases the application also includes a Physical Inspection of a Vehicle or Watercraft, State Form 39530.
When Indiana uses a bill of sale
For a titled car, the signed title transfers ownership. The bill of sale backs it up with the date and the price.
For vehicles that Indiana does not title, the bill of sale may be the main ownership document. That is when the VIN becomes required.
What makes it acceptable to the BMV
The purchaser's name.
Year, make and model of the vehicle.
The VIN, when the bill of sale is the main ownership document.
The seller's signature and address.
This template asks for every item on that list. The signed PDF shows the seller's drawn signature and the date it was signed.
Common mistakes
Price that differs from the title. The BMV follows the title when the two disagree. Write the same figure on both.
Missing seller address. The BMV lists it as required. Fill it in clause 1 with the street address.
Electronic titles in Indiana
Since July 1, 2025, the BMV lets owners choose an electronic or a paper title. Check which one the seller holds before the sale.
Getting paid safely in a Indiana private sale
Cash and cashier's checks are the usual choices. Meet at the buyer's bank when the amount is large, so the teller confirms the funds.
Do not hand over the title until the money is in your account. A signed bill of sale with the price paid protects the seller only after payment clears.
If the buyer pays by bank transfer, wait for the confirmation in your own banking app. Screenshots sent by the buyer are not proof of payment.
What the buyer should check before signing
The VIN on the dashboard, the door jamb and the title match.
The name on the title is the seller's name.
The title shows no open lien, or the seller has the lien release.
A mechanic you trust has looked at the vehicle.
A vehicle history report shows no salvage or flood record.
Once both sides are satisfied, send the bill of sale for signature. In Indiana, buyer and seller usually sign the same day the keys change hands.
Is an Indiana bill of sale signed online legally binding?
Yes. The ESIGN Act gives electronic signatures the same effect as handwritten ones. The signed PDF and its certificate show who signed and when.
Does the bill of sale need the VIN?
Yes, when it is the main ownership document. The BMV does not require it when the bill of sale only supports a title.
Does an Indiana bill of sale need a notary?
No. The BMV says it is not required to be notarized or signed under penalties for perjury.
Is this the same as State Form 44237?
No, but it carries the same data. The BMV accepts Form 44237 or a similar document.
Can I sign the title itself on my phone?
No. The title follows the state's own process, on paper or as an electronic title where the state offers one. The bill of sale is the document you sign here.
Does the other party need a SignSolú account?
No. They open the link on their phone and sign with the brown bar at the bottom.
Can I edit the clauses before sending it?
Yes. After «Use this template» you can change any clause before you send it.
