What happens if you break a lease, and the one termination right that is federal
Leaving before the end of a fixed term is a breach of contract, not a criminal matter, and what you owe is usually money rather than the whole remaining rent. How much depends on your state and on your lease: an early-termination fee if the lease has one, the rent until the unit is re-let where the landlord has a duty to mitigate, plus deductions from the deposit for actual damage. One right does not depend on the state at all: under section 3955 of title 50 of the US Code, a servicemember who enters military service or receives qualifying orders may terminate a residential lease by delivering written notice and a copy of the orders, and the statute sets the effective date.
The three things people get wrong
Before the mechanics, three corrections, because they change how the conversation with the landlord goes.
- It is a breach, not an offence. Leaving early does not create a criminal record and does not create an automatic debt for the whole remaining term. It creates a claim for the landlord's actual loss, and in many states a duty to try to reduce it.
- Walking out silently is the expensive version. The cost difference between a negotiated exit and an abandoned unit is usually larger than any early-termination fee, because of the months nobody was looking for a tenant.
- The lease is the first document to read, not the statute. Many leases already contain an early-termination clause with a fixed number of months' rent. If yours has one, that number is usually the ceiling of the negotiation.
| Situation | What usually drives the outcome | Where the rule comes from |
|---|---|---|
| Lease has an early-termination clause | The fee the clause names, often 1–2 months | Your lease |
| No clause, you give notice and leave | Rent until the unit is re-let, where mitigation is required | State law, varies |
| No clause, you leave without notice | The same, but the clock starts later | State law, varies |
| Landlord breached first (habitability, entry) | Possible constructive eviction defence | State law, varies |
| Servicemember with qualifying orders | Statutory termination on a date the statute sets | 50 U.S.C. § 3955 |
| Month-to-month tenancy | Notice period only, no early-termination problem | Your lease and state law |
The federal right, and exactly how it is exercised
Section 3955 of title 50 of the US Code lets the lessee on a covered lease terminate it, at the lessee's option, at any time after the lessee's entry into military service, the date of the lessee's qualifying military orders, or the date of a stop movement order. Subsection (b)(1) describes the covered residential leases: premises occupied, or intended to be occupied, by a servicemember or their dependents for a residential, professional, business, agricultural or similar purpose, in the circumstances the subsection lists.
Three features of the section that matter beyond the servicemember themselves. Subsection (a)(2): a termination also terminates any obligation a dependent of the lessee may have under the lease. Subsection (a)(3): the spouse or dependent may terminate during the one-year period beginning on the date of the lessee's death, if the lessee dies while in military service or while performing covered duty. Subsection (a)(4): if the lessee incurs a catastrophic injury or illness during a period of military service or covered service, the lease may be terminated during the one-year period beginning on that date, by the lessee or, where they lack the capacity to manage their own affairs, by their spouse or dependent.
How notice is given — including electronically
Subsection (c)(1)(A) is the mechanism: termination is made by delivery by the lessee of written notice of the termination, and a copy of the servicemember's military orders, to the lessor or the lessor's agent. Subsection (c)(2) lists the ways that delivery may be accomplished: by hand delivery; by private business carrier; by certified-style mail with sufficient postage and return receipt requested, addressed as designated by the lessor; or by electronic means, including direct delivery to an electronic address designated by the lessor or its agent, the posting of material to a website or other electronic repository to which access has been granted, and other electronic means reasonably calculated to ensure actual receipt.
That last clause is unusual and useful: the statute itself contemplates electronic delivery, and the standard it sets is actual receipt. Which means the practical question is not whether email counts but whether you can show it arrived.
When the termination takes effect
Subsection (d)(1)(A) sets the date for a lease of premises with monthly rent: termination is effective 30 days after the first date on which the next rental payment is due and payable after the date on which the notice is delivered. For any other covered lease of premises under subparagraphs (A) and (B) of subsection (b)(1), termination is effective on the last day of the month following the month in which the notice is delivered. For a lease covered by subsection (b)(1)(C) — the stop movement case — termination is effective on the date the requirements of subsection (c) are met.
So the date is arithmetic, not negotiation. Deliver the notice on the 20th with rent due on the 1st, and the lease ends 30 days after that 1st. Knowing the formula is what stops a landlord from charging to the end of the term.
What to do, in order
- 1Read your own lease first, looking for three things: an early-termination clause, a subletting or assignment clause, and the notice provision with its address for notices.
- 2Check whether a statutory right applies to you — military orders, or a state-specific right — before you offer to pay anything.
- 3Write to the landlord, with a date. A proposal with a move-out date, an offer and a deadline gets an answer; a phone call does not.
- 4Offer to help re-let. Showing the unit, flexible access and a clean handover shorten the vacancy, which is the number your exposure is measured by.
- 5Ask about assignment or subletting, because a replacement tenant the landlord approves is usually cheaper for both sides than an empty unit. The document is the lease addendum or a fresh lease agreement, depending on which the landlord prefers.
- 6Put the agreement in writing before you move out, not after. The form is the lease termination letter, and if money is being settled, the settlement agreement template.
- 7Document the condition of the unit on the day you leave, with dated photographs. The deposit argument is always about condition, and it is always won with evidence taken on the way out.
The background on what the lease itself should have said — term, renewal, notice, deposit — is in breaking a lease, and if what you have is a rolling arrangement rather than a fixed term, the shape of the document is different: the month-to-month lease agreement. If you are extending rather than ending, the form is the lease extension agreement.
The notice is the document, so make it provable
Whether you are exercising a statutory right or negotiating an exit, everything turns on a notice that the other side received on a particular date. Under section 3955 the effective date is counted from delivery; in a negotiated exit, the date of your notice is what the landlord's mitigation period is measured from. A notice you cannot prove you sent is a notice you did not send.
With SignSolú the termination letter or the exit agreement goes out over WhatsApp from your own number or by email, the other side signs or acknowledges from a phone without creating an account or paying anything, and the audit receipt records the time, the IP address, the device and the SHA-256 hash of the file. That is a dated record of delivery and of what was delivered, which is precisely what subsection (c)(2)(D) describes as electronic means reasonably calculated to ensure actual receipt. Anyone can check later that the document did not change at the verification page, with no account. If the lease is in Mexico rather than the United States, almost none of the above applies: the rules come from the civil code of the state where the property is, the notice formality can be stricter, and in some states the tenant has a statutory extension. The starting points are renting in Mexico City as an American and is an electronic signature valid in Mexico?.
Frequently asked questions
What happens if you break a lease?
It is a breach of contract, so the landlord has a claim for their actual loss. In practice that is the fee an early-termination clause names, or the rent until the unit is re-let in states that require the landlord to mitigate, plus deductions from the deposit for actual damage. It is not a criminal matter.
Do I owe the whole rest of the lease?
Not automatically. Many leases cap the exposure with an early-termination fee, and many states require the landlord to try to re-let the unit, which reduces what you owe. The rule differs by state, so read your lease and your state statute.
Can a servicemember end a lease early?
Yes. Section 3955 of title 50 of the US Code lets the lessee terminate a covered lease at any time after entering military service, after the date of qualifying military orders, or after the date of a stop movement order, by delivering written notice and a copy of the orders.
When does a military lease termination take effect?
For a lease of premises with monthly rent, subsection (d)(1)(A) makes it effective 30 days after the first date on which the next rental payment is due and payable after the notice is delivered. For other covered leases of premises it is the last day of the month following the month of delivery, and in the stop movement case it is the date the notice requirements are met.
Can that notice be sent by email?
Subsection (c)(2) allows delivery by electronic means, including direct delivery to an electronic address designated by the lessor or its agent, posting to a repository to which access has been granted, and other electronic means reasonably calculated to ensure actual receipt. What matters is being able to show it arrived.
Is it better to sublet than to break the lease?
Often, if the lease allows it and the landlord approves the replacement. A unit that stays occupied removes the vacancy that your exposure is measured by. Check the subletting or assignment clause before you propose it.
